The lower court ruling stands on $2.1 billion in damage for contaminated powder.
The Supreme Court turned down a Johnson & Johnson appeal challenging a $2.1 billion civil judgment awarded to 22 women who alleged the company’s talcum baby powder caused ovarian cancer. In a brief written order, the High Court left the Missouri appeals court ruling against the company in place.
The women, all of whom had developed cancer, brought their product-liability claims in 2015, alleging that the company’s talcum contained asbestos and that J&J knew it and kept it secret.
The company denied the asbestos claims or that the talcum products were carcinogenic and, in a court brief, said epidemiological studies “have found no meaningful association between cosmetic talc use and ovarian cancer.”
